We are sworn to read and apply to the best of our abilities, all laws and ordinances as written, &amp; in accordance with Durham&#8217;s Comprehensive Plan. The Planning Board strives to preserve the character and livability of our community, while upholding property values. In reviewing applications, we strive to respect the applicant&#8217;s rights, those of abutters, and all others affected by the proposed land use activity.  After a thorough review of an application, the Board may have to say No! If an applicant is unsatisfied with this decision, an appeal may be made to the Board of Appeals. </em></p>
<p><em>Detailed written minutes, a DVD recording and digital audio recording serve as legal records of this public meeting.&#8221;</em></p>

<p>Mr. Crowley appeared before the Planning Board to continue his application for wilderness campsites.</p>

<li>A sign plan was submitted.</li>
<li>Shawn Bennett Interim Road Commissioner stated by e-mail the site distance is adequate.</li>
<li>A letter from Maine Historical Preservation.</li>
<li>A letter from Brent Lawson/Dave Libby was unable to obtained. D. Feeney Codes Enforcement Officer will call Brent Lawson and confirm the information on privies for the campsite.</li>

<p><strong>6. New Business:  </strong><em></em></p>
<ul>
<li><em>7:15 pm</em><strong>: Maine RSA#1, Inc. (AKA US Cellular), KJK Wireless: Map 8 Lot 17 Conditional Use Permit for a Cell Tower and Facilities</strong></li>
</ul>
<p><strong>Robert Gashlin appeared before the Board to present his Conditional Use Application for a Cell Tower and related Facilities.</strong></p>
<p align="left">R. Gashlin gave brief overview about the project. Site location research was done by electrical engineers. US Cellular has existing towers in Lisbon (1), Topsham (1), Freeport (2), Pownal (1) and Pineland (1). The engineering study showed a gap in cellular communications in the West Durham area. After the study was completed, the land of Maine Gravel Services was chosen as the site for the new tower and facilities. This will close the gap in coverage on US Cellular phones.  Neighbors&#8217; concern was the height of the proposed tower (250&#8242;).</p>
<p align="left">
<p align="left">The proposed site is located at the Maine Gravel Services (38 acre lot) owned by Frank Crooker. This property is leased. These towers are commercial structures. The zone is Rural Residential, which requires a Conditional Use Permit.</p>
<p align="left">
<p align="left">Mr. Gashin presented a very in-depth response to the application.</p>
<p align="left">A full environmental study was done as where this new tower could be placed.</p>
<p align="left">
<p align="left">The first action is to see if the application is deemed complete.</p>
<p align="left">List of Abutters is included in the site plan page c-1. Green cards were turned in with the exception of Abe Curtis <em>(Abe Curtis picked up on 4-4-2012).</em> The ordinance requires that certifications be sent out not more than 30 or less than 10 days. Abutters have 15 days to pick up certified letters from time notified. The certified letters were sent out on March 24<sup>th</sup>, which meets the ordinance criteria.</p>
<p align="left">There were no abutters present at this meeting, only  two neighbors.</p>
<p align="left">
<p align="left">The property leased from Maine Gravel Services. There are 38 acres, however due to resource protection and the Aquifer overlay areas (page C-1 &amp; C-2) only a small [100’ x100’] area in the southeast corner is available to be used. The project has been fully engineered. The easement to access the proposed development is 50’ wide and about 200’ long. The parking area with turnaround is 2675 sq’. All the 100’ setbacks were met. Meets, Bounds and bearings have been completed. Mr. Gashlin stated that the project meets the FAA &amp; FCC requirements.</p>
<p align="left">A cover letter, letter from Maine Gravel Services, Deed, letters from A &amp; D Klumb Environmental, LLC, Department of Conservation, Fish &amp; Wildlife, Feema Flood page showing areas, Google pictures depicting site, a Map from Inland Fisheries and Wildlife showing deer wintering &amp; NRPA Bird Habitat, a financial statement and construction schedule.</p>
<p align="left">
<p align="left">According to the plans some fill will be required to lay the pad, foundation and parking area. There will be minimum tree cutting. Sediment and Control areas can be seen on pages G-1 and D-3.. The applicant agreed to the Board&#8217;s recommendation that the electric be underground (to <em>save trees &amp; minimize visual impact by narrowing the road clearing to less than 20&#8242; </em>).</p>
<p align="left">The area will be enclosed by a 75’ x 75’ fence. The chain link fence is to be 8’ high. The inside area will consist of a 12’x 20’ shelter, 250’ tower, a 35 KW generator for power failure. Under the &#8220;Katrina Act&#8221; cell towers must have a back-up generator that will provide at least 8 hours of backup service. The anticipated noise from this generator will be 53 decibels at the 100’ set back.   The maximum noise level per the Land Use Ordinance is 55 decibels.</p>
<p align="left">
<p align="left">The 250’ lattice style tower is to be made of steel. Then tower is put up by a crane in sections. The three legs on the bottom are to be set on cement pads vs. guy wires. The tower is designed to crumble and falls on itself. If the Tower falls legally it has to fall on the Crooker property. The nearest home is the Curtis’, which is 750’ away.</p>
<p align="left">
<p align="left">On the tower are 2 spaces for US Cellular and 3 more spaces for additional Cellular users.</p>
<p align="left">
<p align="left">D. Feeney C.E.O.  Recommended that this be a gated property to protect the equipment.</p>
<p align="left">
<p align="left">R. Jabaut recommended that perhaps the generator and fuel tank be enclosed in a cement containment area.</p>
<p align="left">
<p align="left">Construction will take approximately 6 weeks to complete.</p>
<p align="left">
<p align="left">Public Welfare/Livability</p>
<p align="left">
<p align="left">From the Land Use Ordinance pages 33, 35 and 43. Specifically L.U.Ordinance, Article 6; Approval Standard: F Criteria 5G and G Criteria 5H. Also referral to Ordinance done for CMP Reliability Project/ 2008/2009.</p>
<p align="left">
<p align="left">D. Feeney C.E.O. stated when the A.T.&amp; T. Tower was put up at the Durham Leisure Center there was a tower height marker Balloon flown so that residents and abutters could get an idea of the height of the tower as part of the application. After discussion it was agreed US Cellular would fly a balloon on April 24<sup>th</sup> from 7 am to 10 am for residents and abutters to view at the proposed tower site, with a rain date of April 25<sup>th</sup> 7 am to 10 am.</p>

<p align="left"> Chairman Jabaut recommended that there be legally binding provisions that if the tower becomes vacant after a time period the tower will be dismantled.   US Cellular stated that they have provisions in print that state what happens when a tower is not used. D. Feeney recommended that if the tower is vacant more than 18 months it will be removed. R. Jabaut recommended that there be as a condition for issuing the permit, that an irrevocable financial surety to remove the tower and restore the site exist between US Cellular and the Town of Durham.  It would provide the necessary clean-up funds should the corporation cease to exist and or the tower be abandoned due to technological obsolescence or disuse.</p>

<p>Beginning July 1 the newsletter will be electronic only (by e-mail). <h2>May Will Be A Busy School Month</h2>
<p>Another busy month awaits. On May 3 the K-2 students will attend a special school concert at the Freeport Performing Arts Center. An after-school Bike Club also starts on May 10. The Board met in April at Durham Community School, which bursts with energy. We have two more public budget meetings coming up at 6:30 p.m. on May 2 and May 9 at Freeport High School. Budget adoption is set for May 9.</p>
<p>That proposal will then be reviewed and voted on by the whole school community at 6:30 p.m. on May 23 at the High School (look for your town clerk when you enter and get your voting card). The budget validation referendum vote is set for 8 a.m.-8 p.m. on June 12 at Durham Community School. Absentee ballots will available at Town Office beginning May 14.</p>
<p>With nicer weather, the Durham Community School baseball, softball, track, and lacrosse teams are all playing and taking full advantage of the new fields. A Durham Community garden is also being created, and if you would like to help with time or materials, please contact <a href="mailto:corenw77@gmail.com">corenw77@gmail.com</a>. <h2>Should The Town Stay In The Regional School District?</h2>
<p>The Board of Selectmen is seeking volunteers for a committee that will explore options to being part of RSU5. All interested citizens should apply to the Board by 4:30 p.m. on May 8. Applications are available at Town Office during regular business hours.</p>
<p>In a related move, the  Support the RSU5 Action Group has been formed to get voters informed. <h2>Volunteers Sought For Roads Committee</h2>
<p>The Board of Selectmen is forming a Government Study Committee that will look into the feasibility of a Pubic Works Department and conduct associated road studies. All interested citizens should apply by 4:30 p.m. on May 8. Applications are available at Town Office during regular business hours.</p>
<h2>Fire Department Looking At A Bargain Used Ladder Track</h2>
<p>Durham Fire &amp; Rescue has had a used ladder truck in its capital plan for the last eight or ten years. The economic downturn forced the department to push the buy back, and list it for 2013. But now Topsham is replacing its ladder truck, with the new one due in about a week. Once training takes place and they accept the new ladder, the existing one will be a trade-in. The truck will be sold for $25,000, a small fraction of what was listed at in the capital plan. It would require no more than $15,000 for the radio transfer, lettering, and a few pieces of equipment.</p>
<p>The truck is older than what the department had planned to buy, but is in good condition, with low ladder hours and mileage. The Apparatus Committee feels it presents an excellent opportunity for the community, but a purchase cannot wait until next year’s annual Town Meeting. So the department asked the Board of Selectmen to consider holding a special Town Meeting to request the purchase. If the Board approves, it would have to be held near the end of May and no later than the first part of June. The revenues are on hand.</p>
<h2>Town Wants To Hire A Public Information Technician</h2>
<p>It&#8217;s a part-time position and it requires skills in communication and writing, and knowledge of a wide range of software and operating systems. The job will be performed under the guidance of the Telecommunications Committee, but requires independent work. Minimum requirements include graduation from an accredited high school, supplemented by technical training or any equivalent combination of experience and training related to the job. The successful applicant must provide and maintain his or her own computer system compatible with any software that may be required, and provide an internet connection.</p>
<p>Salary depends on experience and qualifications. A full job description is available at the Town Office or <a href="http://www.durhamme.com">www.durhamme.com</a>. Please submit a resume with three professional references to: Town of Durham, Public Information Technician, 630 Hallowell Rd., Durham, ME 04222, no later than 4:30 p.m. on June 1. <h2>Fire Permit Information From Town Forest Warden</h2>
<p>Anyone wanting to burn logs, brush, grass, pasture, or blueberry land, or have a campfire is required by Maine Law to obtain a burning permit. Timing will depend in part on the availability of Fire Department personnel, as well as the class day and local weather conditions. The person who signs the permit is legally responsible for the fire and must adhere to all safety precautions and time frames. The fire must be attended at all times, and the signer is legally responsible for any damages or suppression costs resulting from the fire.</p>
<p>On Saturdays and Sundays, permits are available at the Fire &amp; Rescue Station at 9-11 a.m., and on weekdays, they may be obtained after 9 a.m., but are controlled by availability.  Now you can also get them online at <a href="http://www.maine.gov/burnpermit/">http://www.maine.gov/burnpermit/</a>, but that requires a $7 fee for a two-day permit. <h2>Masonic Lodge Bean Supper</h2>
<p>The supper will happen at 4:30-6 p.m. on May 12 at the Masonic Lodge on Route 136 across from River Park. Prices are $7.50 for adults, $3 for children age 5-12, and free under 5. On the menu are baked beans, chop suey, hot dogs, potato salad, coleslaw, bread, pickles, and homemade pies.</p>
<h2>Roadside Cleanup Through May 19</h2>
<p>You may go to the Town Office and pick up clear trash bags. The large clear bags are the only bags that Pine Tree waste will recognize. If you leave bags on the roadside after May 19, the bags will require a $3 trash tag. For more information call 353-2561.</p>
<h2>Durham Bulky Waste Day</h2>
<p>There will be only one bulky waste pick-up this year, and it&#8217;s at 9 a.m.-3 p.m. on May 19 at the Eureka Community Center Field. Durham residents only. You must show a driver’s license or a utility bill with current Durham address. To facilitate offloading, light and small loads will get priority. <strong>No commercial waste</strong>, garbage or household trash, recyclable items, hazardous wastes and car batteries. <strong>Accepted:</strong> Refrigerators and air conditioners, etc. (must be red-tagged to show Freon has been removed), appliances, furniture, mattresses and box springs, large metal items, scrap, storm doors, outdoor furniture, large plastic items, toys, passenger car/pick-up truck tires. No dump truck tires or loader tires. Universal wastes/electronics accepted are televisions, monitors, computers under 26 inches, fluorescent light bulbs, and batteries. Non-alkaline batteries can go in your regular trash.</p>
<p>What&#8217;s new this year is that there will be no charge for these items. Price lists for car/pick-up truck tires, Regional Environmental Depot, and Freeport Recycling Center will be available on or about May 10 at the Town Office (printed), Durham website and Town Channel. For more information on bulky waste clean-up, call the Town Office at 353-2561.</p>
<p>You can also take the waste to the Regional Environmental Depot in Lewiston on two Saturday mornings a month: Household cleaners, oil-based paints, solvents, insecticides, and gasoline. Contact the Town Office to get a voucher, go to <a href="http://www.avcog.org">www.avcog.org</a>, or call 783-9186 for more information. The Freeport Recycling Center will take your building debris, brush (no stumps), Freon-containing appliances, shingles, and oil, all for a fee. For more information and hours, call 865-3740.</p>
<h2>Eureka Community Center Bulky Waste Pick-up</h2>
<p>Eureka volunteers will pick up items that need to go to the bulky waste collection site on May 19. This special pick-up is for Durham residents who are physically not able to load their own items and have no way to get their items to the site. The committee is asking for a $25 donation per load. The items must be easily accessible. An inspection of the items has to be done before May 19 so that you can be put on the list. Call Anita Sellars as soon as possible at 353-6217.</p>
<h2> &#8230;And Plant Sale</h2>
<p>On May 19, the Eureka Committee will host a plant sale from 8:30 a.m. to 2 p.m. at the Eureka Community Center. Look for the Eureka Café, featuring Ernie’s Chili, hot dogs, chips, cold drinks, and coffee, as well as hanging baskets, annuals, perennials, vegetable, and herb plants. Proceeds benefit the Eureka Center.</p>
<h2>Durham&#8217;s First Memorial Day Celebration</h2>
<p>On May 28, Durham will have a parade honoring our veterans. It will begin at 10 a.m. at Davis Road and run south on Royalsborough Road (Route 136) to the back entrance of Durham Community School. Stops will be made at the Gazebo and Sawyer Cemetery. A Fun Run will benefit AMVETS Post 13. Parade, Fun Run, and sponsor forms are available on the town website and at the Town Office, Durham Get-n-Go, and Asselyn’s Garage.</p>
<h2>News From Lisbon Area Christian Outreach</h2>

<h2>Ninth Annual Ride Against Hunger</h2>
<p>Benefiting Good Shepherd Food Bank, it happens June 2, with registration from 8:45-9:15 a.m. at the Durham Get-n-Go on Route 136. The donation is $10 (which provides $80 in food) per rider, and riders depart at 9:30 for Good Shepherd on Hotel Road in Auburn for a bike blessing and lunch sponsored by the Christian Motorcycle Association. <h2>Coastal Humane Society Hosts Rabies Clinic And Plant Sale</h2>
<p>From 9 a.m. to 11 a.m. on Sunday, May 6, a rabies vaccine will cost $10, nail trimming $10, ear cleaning $5, and ID insertion $25. The plant sale will be held at 10 a.m.-2 p.m. on May 19 and 20. Both will happen at 30 Range Rd., Brunswick.</p>
<h2>Durham Historians Set Art Show, Bake Sale, And Meeting</h2>
<p>The Durham Historical Society will hold a Spring Art Show featuring local artists at 10 a.m.-1 p.m. on Saturday, May 19, at the Union Church/Old Durham Town Hall on Route 136. There is no admission fee. The bake sale will benefit the DHS Restoration Fund. The Historical Society will also meet at 6 p.m. on May 8, same location, for spring clean-up and monthly meeting.</p>

<h2>News From Rep. Ellie Espling</h2>
<p>As the legislative session ends, it&#8217;s time to look back. Education is an area where we saw some significant changes over the past two years. Perhaps the biggest change came with the passage of &#8220;An Act To Create a Public Charter School Program in Maine&#8221; (sponsored by Sen. Garrett Mason). That made Maine the 41st state to allow public charter schools. The legislature also passed &#8220;An Act To Restore Equity in Education Funding” (sponsored by Sen. Kevin Raye), aimed at providing more state assistance to rural school districts.</p>
<p>Another successful piece of legislation (still awaiting funding approval) was &#8220;An Act To Prepare Maine People for the Future Economy,” (sponsored by Sen. Brian Langley), which mandates what is commonly called standards-based education. Beginning in 2017, new high school diploma standards and requirements must be in place in order for students to graduate.</p>
<p>&#8220;An Act To Prohibit Bullying in Schools&#8221; (sponsored by Rep. Terry Morrison and also awaiting funding approval), requires the Department of Education to develop a model policy on bullying. The bill also defines &#8220;bullying&#8221; to include cyber bullying, and requires that anti-bullying policies be incorporated into student handbooks and published online. <p> Special note: There will be only (1) one bulky waste pick up this year.</p>
<p>The date is <strong>Saturday, May 19th and the time is 9 a.m. to 3 p.m.</strong> at the Durham Eureka Community Center Field. <strong><span style="text-decoration: underline;">Durham residents only.</span></strong> You must show a driver’s license or a utility bill with current Durham address. To facilitate offloading, light and small loads will get priority.</p>
<p><strong>No commercial waste, </strong>no garbage or household trash, no recyclable items, no hazardous wastes and no car batteries. <strong>ACCEPTED</strong>: Refrigerators and air conditioners, etc. (must be red-tagged to show Freon has been removed), appliances, furniture, mattresses and box springs, large metal items, scrap, storm doors, outdoor furniture, large plastic items, toys, passenger car/pick-up truck tires. No dump truck tires or loader tires.</p>
<p><strong> Universal Wastes/ Electronics</strong> accepted are televisions, monitors, computers under 26 inches, fluorescent light bulbs and batteries. Non-alkaline batteries can go in your regular trash.</p>
<p><strong>New this year there will be no charge for these items.</strong></p>
<p><strong>Price lists </strong>for Car/ Pick-up Truck Tires, Regional Environmental Depot and Freeport Recycling Center will be available on or about May 10<sup>th</sup> at the Town Office (printed), Durham Website and Town Channel.</p>

<h1 align="left">Other places to take waste</h1>
<p><strong>Regional Environmental Depot</strong> in Lewiston on two Saturday mornings a month will accept household cleaners, oil-based paints, solvents, insecticides and gasoline. Contact the Town Office to get a voucher or go to <a href="http://www.avcog.org/">www.avcog.org</a> , or call 783-9186 for more information.</p>
<p><strong>The Freeport Recycling Center</strong> will take your building debris, brush (no stumps), Freon-containing appliances, shingles and oil, <strong><span style="text-decoration: underline;">all for a fee</span></strong>. For more information and hours call 865-3740. </p>
